Mistrial Declared After Victim's Eye Pops Out Of Its Socket During Jury Trial

Philadelphia, PA (The Weekly Vice) - A mistrial was declared last Wednesday when a victim's eye popped out of its socket while he testified against the man responsible for assaulting him.

According to court records, 23-year-old Matthew Brunelli allegedly attacked victim John Huttick in August 2011 while the two men were visiting the New Princeton Tavern in Philalelphia.

During the attack, Huttick was allegedly punched in the face as he attempted to break up a fight between Brunelli and another man. Huttick sustained permanent damage to his eye during the assault.

Huttick was testifying that the injury left him jobless and depressed when he started to weep on the stand.  That's when his eye suddenly popped out of its socket and dropped into his hands. Members of the jury gasped and began to rise when the judge recessed the court.

The defendant's attorney asked the judge for a mistrial, arguing that the suspect would be unable to get a fair trial after the jury had witnessed such a spectacular event.  The judge granted the mistrial, calling it an "unfortunate, unforeseen incident."

A new trial for the case 'Commonwealth v. Brunelli' has not yet been scheduled, but is expected to take place in March.
