Naples, FL (The Weekly Vice) - Mark Abaire, a 52-year-old Florida man was charged with a felony after he allegedly filled a water cup with soda while visiting an area McDonalds restaurant.
According to police, Abaire entered a Naples McDonald's restaurant, asked for a water cup and then proceeded to the drink fountain.
Instead of filling the cup with water, he helped himself to a soda and exited the restaurant.
Investigators say a manager found Abaire sitting outside and asked him to pay a dollar for the soda. Abaire refused. When the manager asked Abaire to leave the premises, Abaire again refused.
Police arrived a short time later and arrested him for what would normally be a petty theft charge. But because Abaire had prior theft convictions, his charge was increased to a third-degree felony theft charge.
Abaire was booked into the Collier County Jail on charges of felony theft, trespassing and disorderly intoxication. His bond was set at $6,500.
