Pahrump, Nevada (The Weekly Vice) -- Michaela Griffin, 28, and her 16-year-old live-in boyfriend Danny Linville, have been arrested after a two-year-old toddler arrived at a Nevada hospital requiring emergency brain surgery for alleged abuse.
A mother of three children (aged 2,6 and 8) and two minors were arrested Wednesday after authorities say she left her children in the care of her 16-year-old boyfriend who then became angry and assaulted the woman's two-year-old son.
According to police, Griffin left her children in Linville's care, as she often did, to go to work. Linville allegedly told detectives that he had become irritated when the toddler bit him while he was trying to brush his teeth.
Linville told police he then stuck the child in the face, causing him to tumble backwards into a bathtub and corner-wall. Linville then allegedly grabbed the child's throat and strangled the unresponsive child, according to police.
Detectives say a 14-year-old teen was also in the apartment when the attack occurred. Linville allegedly told the 14-year-old that the child had fallen on it's own into the bath tub and demanded that he not tell anyone anything else, according to the arrest report.
The 16-year-old then left the unresponsive child with the 14-year-old to find a neighbor for help. Authorities were contacted a short time later.
When police arrive, both teens allegedly offered multiple stories about how the incident occurred. When detectives explained how the stories did not match the evidence found at the scene, both teens abandoned their story and admitted to the assault.
The 16-year-old now faces charges of attempted murder and child abuse with substantial bodily harm. Prosecutors are reportedly seeking to try the teen as an adult.
The child's mother was also arrested on three counts of felony child abuse for allegedly failing to report previous abuse and leaving the children in the care of that minor for large periods of time.
The two-year-old victim was airlifted to the University Medical Center's Trauma unit, where he underwent emergency surgery to relieve swelling of the brain. As of Thursday, the child is still being listed in critical condition.
The Weekly Vice Opinion:
Should this teen be tried as an adult? We think he absolutely should. He has a 28 year old girlfriend, lives with her, watches her kids, beats her kids. We see no signs of innocent youth here.

Wait a minute, maybe a dumb question here. But the 28 yr old mother was arrested for felony child abuse for failing to report abuse, but she wasn't charged with having a sexual relationship with (and living with) a 16 yr old? Don't you publish stories all the time about 28 yr old teachers being arrested for this? Does anyone else see something wrong with this picture?
I'm usually never a violent person...but I want to beat that woman's ass. 28 years old, dating a 16 year old boy and allowing him to abuse your child? She's more guilty that he is.
Yes Charlie,
But in some states, 16 is the age of consent EXCEPT in the case of a teacher - who cannot have sex with a student because he/she is in a position of trust.
That's the major difference.
Now if a teacher has sex with a teen, but that teen isn't their student in any way, many states won't prosecute that either.
If a teacher is in authority in some way... tutoring, coaching, teaching, counseling... then that position of trust is breached - triggering the charge.
Absolutely try this kid as an adult. I have 3 kids myself and I couldn't imagine doing something like that to them. If I ever saw my wife or anyone else doing something to them that would be it. I hope this "kid" that is trying to live an adult life gets tried as just the same.
Oh okay... so the fact that she's not a teacher/in a position of trust makes it soooo much better. I'll let you know when I'm done rolling my eyes at that one (not you danny, the legal system).
Yes,try him as an adult.
Sahar, I agree with you. In a way, she simply adopted another kid that she could have sex with.
Heck, her oldest kid isn't all that much younger. That's just twisted. She should at least let the kid get old enough to grow a mustache.
I looked it up. The age of consent is 16 in Nevada for heterosexuals and 18 for homosexual sex.
But if he's watching kids, when is he going to school? where is his parents. People are whacked.
Please remember that the kid is a minor- he is 16 years old for God's sake...child abuse to him, could be the normal way that she treats her children everyday (although she has already thrown him under the bus- who would expect her not to?), there is a chance he doesn't know any better. Obvioiusly, he is a bad situation already, how do we know that he wasn't treated this way growing up? Obviously there is a reason that he is living with someone other than family. The bottom line to me is that the girlfriend had absolutely no place being with this young teenager.
Absolutely, try him as an adult. His sexual relationship with the mother is a separate issue altogether. Perhaps he came from an abusive home since at 16 he's living in that situation, but if so his defense can bring that up at trial. At 16, he is old enough to know that what he did to that young child was wrong, and he is old enough to know that he can seriously injure such a young child.
yes he diserves what he gets but you guys have no idea about what the hell is going on. 16 and 28 yea its a big diffrence but oh well its not against the law in nevada and iam very close to both danny and michaela and danny was never a violent person. so if he slipped and did do it ya it sucks but michaela does not diserve to be in jail she was at work when all this happened she needs to be in the hospital with her baby and not waiting for a court date to get out she does not deserve to be in jail!!!!!!!
None of you have your facts straight. All you hear is what the media wants you too...I should know, I work at a tv station.
But he happens to be my cousin.
He's not the monster the media is making him out to be.
You don't know half of the story and I'm not condoning what he did and I'm not saying it's okay but I know he didn't do this intentionally he isn't a violent child abuser.
Well, T.... since no one has their facts straight, why don't you have a chat with the police about it? This report is not taken from the media, it's taken off the police report. If you have a bone to pick, pick it with them. In the meanwhile, I'm inclined to believe the arresting officer over a cousin who would obviously be biased. Feel free to email me if you have a side of the story you think differs from police.
Again, I work for a t.v. station and I got the police report when it was first released. So yes I knew what you had published was the police report thank you very much. But the media and even the police report is making it out as if he did this all intentionally.
He made a mistake and I think yes he should be punished like anyone else. However, I don't believe that he should be tried as an adult because I know first hand that he's not mentally mature like an adult.
As far as she goes I've met the mother a few times, which I had no clue she was sleeping with him or that she had him living with her.
I would have stepped in and said something if I knew that. Which is probably why no one told me I'm sure.
And yes I do feel there had been some false accusations and observances that were written down in the report but no I'm not going to bring it up to the police because they're not going to change anything and it would be a waste of my time.
I can agree to that. We catch authorities padding up the report from time to time, so the prosecutor has a better chance of trying the case as an adult. But we've also seen judges take the prosecutor apart in court for going overboard, so I hope if there's something overblown here, someone gets the right information to the defense attorney so he can get the case kicked back down into juvenile court. At least THERE, the court tries to turn young people around. In adult court, they just lock them up.
let me start off by saying i am the father of a 1 month old baby boy and when i look at him it just fathoms me how someone can abuse the poor innocent children this is the second worst story of child abuse i have heard this week in the state of louisiana where i live a man slit his 2 year old sons throat to avoid paying 4,000 in back child support now as far as this punk ass kid goes try him as an adult your man enough to have a 28 year old girlfriend and live with (and most likely have sex with her) then be man enough to accept the consequences for what u did and have fun getting ass raped take it like the man you are
I request that the last post from Ryan be deleted if at all possible. That child has family that loves him and I can't fathom that you sir can say that last sentence when you have a son yourself. You do not know anything about the situation. It is fine to post your thoughts, but I ask that you keep the nasty, cruel, and inconsiderate ones to yourself when speaking about a 16 year old.
little moma. so what ever happened with danny hope he got life in prision and the mother hope she never has kids again she dont deserve them.
