Anoka, Minn. (The Weekly Vice) -- James C. McCartney a 24 year old Spring Lake Park man has been arrested and charged with first-degree assault after he fractured the skull of a 7-month old baby, punishing it for crying. The baby remains in a coma.
The baby's mother, Jessica A. Senn, told police the baby was fine when she left for work about 4:45 p.m. Thursday.
McCartney, who shares the house with his girlfriend and her child, was babysitting the infant while the baby's mother was at work. The baby began crying, which infuriated McCartney .
According to police, McCartney told investigators that he struck the baby on the side of the head, knocking him to the floor. McCartney then said he then slapped the baby while he was laying on the floor.
When emergency crews arrived around 6p.m. they found the boy unresponsive. He was transported to North Memorial Medical Center in Robbinsdale, where emergency personnel operated.
Authorities say the baby suffered a fracture to the side of his skull that also resulted in bleeding in the brain. Emergency personnel have expressed doubts as to whether the baby will survive.
The baby's father, Josh Jeanson, 25, said he went to the hospital Friday afternoon to see his son. He said the boy had no bruises when he last saw him, before the new boyfriend showed up. Jeanson said he and the mother had broken up last fall.
James C. McCartney has been charged with first-degree assault and was booked into the Anoka County Jail

Unfortunately Minnesota is rather goofy on their laws and charging people, so he probably won't do the time he deserves.
Your right. First degree assault hardly covers an act like this. If this baby doesn't make it, I hope he's charged with murder.
the really sad thing about it is that Josh has another child that is 4 and if i ever see jessica im just going to smack her. i used to let her watch my daughter and if i would have known that she would stay with an abusive man i wouldnt have let her see mine im sorry to josh and he knows im here for him but the guy that did it needs his skull crushed in for doingt aht to a baby
