GUILTY
Herman Keith Overcash, the former principal of South Davidson High School, pleaded guilty to three counts of felony sexual activity with a student and received a mix of active prison time, suspended prison time and probation.
Superior Court Judge Kimberly Taylor on Thursday ordered Overcash, 54, to serve an active sentence of two months for each charge, for a total of six months. He gets credit for time he has spent in jail since his arrest in April.
"He has told me that he is sorry for what he did and how it has affected everyone's life - and it even, it has everything to do with our lives. It expands, it goes out, it affects the students at the school and the teachers and everybody and here we are today," Said Overcash' attorney Bill Fritts.
Message To The Victim and Community:
We've allowed for an active forum on this issue during the course of these proceedings. During that time, the name, activities, personality, reputation and dignity of this student has been repeatedly trampled - although she at no time was charged with a crime.
As forum administrator, I want to personally apologize to this young lady if she had the occasion to read any of the comments made on this site.
No parent should ever be put in the position of wondering what school officials are doing with their children.
No student should ever be left to the guidance of adults who engage in sexual activity with other students - consensually or by force.
From this moment on, I will delete any and all comments that impugn the name, activities, persona and/or reputation of the student in this case. It's repulsive, irresponsible and a bad reflection on your community.
Post one comment about this student and I'll delete it within hours.
Furthermore, I want this victim to know that we support her fully. This site will also be cooperative with the student and/or her parents in determining what this link displays. Just email us and let us know if we can be of any help in this regard.
Furthermore, we have been in contact with local police. If I hear one threat or even a suggestion of a threat against this individual, I will provide the i.p address of that individual to authorities - and they can use it as they see fit. Yes, i.p. trackers can be installed on blogger now.

Denton, NC (The Weekly Vice) -- Herman Keith Overcash, a 54 year old principal of South Davidson High School in Denton, NC has been arrested on accusations of sexual activity with a female student.
Police have charged Overcash with two counts of felony sexual activity with a student, according to police records.
Investigators say Overcash had sexual contact with a 17 year old girl on two separate incidents.
Although police have not released many details about the case, they have said that the alleged incidences occurred off of school property and within the last few weeks.
Police first became aware of Overcash' activity when a "third party" reported it.
Following his arrest Overcash appeared before a magistrate who set bail at $250,000. While was reportedly still being held in the Davidson County Jail.
Overcash asked for a reduction in bond, however the prosecutor's office opposed the request, classifying Overcash as a flight risk.
“We believe Mr. Overcash is a flight risk based on statements that he made in reference to the victim that if this matter came to light that he would just have to get in a car and drive to Arizona,” Terry said. “Furthermore he was apprehended by law enforcement officers out of our jurisdiction. Officers found him in Forsyth County.”
Overcash' bond was maintained at $250,000.

It's perhaps the most repeated phrase we see on this site....
and 9 times out of 10, the perp ends up pleading guilty when the evidence finally comes out.
But if he's innocent, we'll certainly use this post to vindicate him. The only thing we hate worse than a sex assaulting teacher....are cops who drag a teacher through the mud without having ample evidence to back of their charges.

I have decided to begin moderating comments on this post - namely those that refer to the witness/victim's personal character.
Alleged victims of sexual assault - particularly minors - are legally afforded anonymity by law.
Comments on this site are one of the very reasons for that legal protection, and I believe everyone has had ample opportunity to have their say.
The line has to be drawn somewhere.
I think most people are agreed that the girl has some issues to work through.
Whether it be a low self esteem, questionable upbringing or a childhood of sexual abuse - teens have a variety of reasons for becoming sexually active at an early age.
An educator - particularly a school principal, is educated, trained and well informed SPECIFICALLY of the laws regarding educators and students.
As an authority figure, the law specifically holds educators accountable for any sexual contact with a minor under their charge, regardless of the reasons for it.
Additionally, educators are certified and accredited in their profession. This works to doubly reinforce to them what their duties and responsibilities are in their chosen profession - legally and ethically.
A 17 year old girl is not legally culpable in this case because she is legally unable to consent to a sexual relationship with a school official.
By law, school administrators are duty bound to ALWAYS put an immediate stop to such conduct, no matter how it started. Period.
One party in this alleged incident had no legal consequence, and therefor did not knowingly break a law.
The other party, if proven guilty, broke a law that he has been specifically liable under NC law to abide by.
Educators have the burden and clear responsibility under state law to refrain from sexual contact with students in their charge.
It's clear, concise and elaborately defined as such in North Carolina law.

It is the prosecutor's duty to decide on what charges to file - not the girl's.
It is the prosecutor's job to weight out the merits of a claim and determine whether the allegations are able to be substantiated in a court of law.
It has been clearly stated in the arrest affidavit that authorities interviewed the girl and questioned her on the matter after a 3rd party brought the issue to their attention.
We will no longer defame, insult or criticize the girl for answering detective's questions - unless it's proven that she responded to their questions in bad faith.
The Grand Jury also weighs out the evidence in a case and indicts if the available evidence is deemed to substantiate the charge.
A witness statement is one of many items a prosecutor evaluates - along with emails, phone conversations, DNA evidence, text messages and statements of the accused, to evaluate the worthiness of the charges.
Therefor, I'm going to ask that people moderate their own statements.
Discuss the case, support the principal, scream at lawmakers for the laws they enact.
HOWEVER:
I will delete comments from here on out that personally address this girl's character, willingness to talk to authorities and/or statements she made as a witness.
I will equally delete any comment that implies guilt of Mr. Overcash - who has every right to have his day in court.

no matter what people want to think. overcash is innocent until proven guilty. the law is what it is in this situation, but people cannot look at overcash on the same page of those who do take advantage of childern, meaning someone not nearly weeks from going away to college. underage, yes, but unaware, not at all. we will all have to see what happens when he is actually convicted or released.
As I said in the other forum, posting full length articles in the comment section is rude, self serving and only upsets people.

In all fairness, its because I made it pretty clear that if they attacked the student involved again, I'd delete the comment.
Evidently that was the whole goal. To attack her personally. No fair debate. No rational conversation. Just a relentless attack of someone who was never charged with a crime and didn't break a law.

i go to south davidson high. luckly i never really talked to mr overcash. i was just a freshman when all this happened. i think it happened mostly because of the way girls dress around our school. i think they should inforce the dresscode a lot more than they have been.
I went to Ledford Senior High School where Overcash was our assistant principal. I figured this would happen sooner or later. He was such a flirt and tease with all girls.
One of the things I found interesting about this situation is that a good number of employees in the system were well aware of his behavior for years and the head admistration certainly was aware also. This man's connections kept him going long after his escapades were discussed routinely. In Davie County those that knew had to resign. My guess is that there are a couple at the main office who had been notified of this behavior long before this happened.
