Nicole "Nikki" Catsouras - Another Example Of The Internet Predator Problem






Meet Nikki Catsouras, a beautiful 18 year old who's life was brutally cut short in a gruesome car crash Halloween night, 2006. Traveling at what the California Highway Patrol estimates to be about 100 miles per hour, an intoxicated Nikki slammed her father's Porsche 911 into a concrete tollbooth.

The accident is really nothing unique unfortunately, but the events that followed provide an extremely sobering example of the evil that lurks within the Internet. It also exposes the tragic reality of how unreasonably ineffective our laws are for dealing with online predators, bullies and harassers.

The details:

Shortly after Nikki Catsouras accident, photographs of the accident were taken by the California Highway Patrol. This is normal policy and a widely followed practice of accident scene investigators who are seeking to preserve the accident scene. Unfortunately for the Catsouras family, this is the point where the their daughter's tragedy would be turned into an ongoing nightmare.

While some details of the case have yet to emerge completely. We do know that someone from the California Highway Patrol leaked these photos to the public. Within a matter of weeks, the accident scene photos succeeded in saturating the Internet.

The photos in question were extremely graphic. The twisted wreckage of the accident are convincing enough, however the most upsetting images were those of Nikki, who's nearly decapitated head was smashed open. Parts of her head were scattered across the scene while Nikki was still seat belted in the driver's seat of the car.

It's important to give a description of the photos, so you'll understand the heinousness of what came next. The Weekly Vice will not show the image of Nikki this article deals with because it is extremely graphic, and that Catsouras family has been plagued enough by it. We have shown one abstract photo of the wreckage, so you'll be able to understand the significance of the damage, and why the Catsauras family would like the more gruesome photos removed.

While the leaking of these images opens many issues about how law enforcement handles it's investigative material, the real outrage is what the Catsourus family was forced to experience next.

Soon after the release of these photos, while the Catsouras family mourned their daughter's death, the family began to receive taunting message along with the most graphic images from their daughter's accident scene. The photos quickly made their way to an estimated 1,600 websites across the Internet.

Just a few days after the accident, Nikki's teenage cousin opened her cell phone and was confronted with an image of of Nikki's mangled remains. This was no isolated event as many members of the Catsouras family began receiving emails, text messages and links to websites which repeated these graphic images over and over.

The statements that accompanied the images were often cruel, poking fun at the beautiful girl who was no longer beautiful. Even the deceased girl's MySpace page had contained anonymous postings of the accident scene, and a tribute site that was created for Nikki was eventually found to be little more than another front for displaying the grizzly photos.

Christos (Nikki's father) and Lesli Catsouras no longer go online or use email accounts. The Catsouras' three children also avoid using the Internet.

"It's evil!" says Nikki's mother Lesli Catsouras. "It's evil, and this was done maliciously as a joke. And it has devastated our lives completely. People should know that this can happen to them."

"There was threats that people were gonna put the pictures on my locker, in my locker," said Danielle (Nikki's sister). "I remember her in such a great way, I don't wanna see it and have that image stuck in my head."

Nikki's mother agrees. "I've stopped using my email," she says. "I don't want to see these every single day. ... And you know, I take a risk every time I go to the computer.

"We talk about Nikki all the time," says Nikki's father Christos. "We've got pictures of her everywhere. We laugh about her, cry. I always called her Angel."

Tyler Offenhauser, the family's attorney laments the utter lack of legal recourse in cases like these. "The Internet is growing in leaps and bounds. The law is not," he explains.

The Catsauras family's lawsuit against the CHP for allegedly releasing releasing the accident scene pictures to the public was recently confirmed by a judge who set the case for trial before a jury.

"They were crime scene pictures that never, ever should have gone out," says Christos. "There was a big mistake made by the California Highway Patrol that was never really acknowledged, or they never wanted to help us once the mistake had been made".

While the CHP has admitted in a letter to the Catsouras family that it's dispatchers violated department policy, it has said it is not responsible for the Catsouras' anguish.

The Weekly Vice Reaction :

Example after example, the story is the same. Internet predators who victimize the innocent with calculating, heinous acts of disregard, continue to go free. Their activities sometimes even condoned as "free speech".

What may be most troubling however is the ever present excuse making of our elected officials who continue to hide under a desk when the public calls upon them for justice in these cases.

In the case of harassing emails, why didn't officials track down the author behind these offensive attacks? The technology certainly exists. Why would tossing a cigarette butt out a vehicle window constitute a graver offense in the eyes of law enforcement, thus prompting immediate action while cases like these languish in silence?

The excuse lawmakers use to let themselves off the hook stem from the growth of the Internet and how fast it's changing. This is a sham. Chat rooms, message boards, instant messengers and email have been in existence for far over a decade now. While the software used to transmit messages changes slightly, the basic essence of using the Internet to send a message is largely the same. Is a decade or two long enough to establish some basic decency laws in regards to Internet usage? The Vice certainly believes it is.

In both the Nikki Catsouras case and the Megan Meier case, we're continually reminded of how inept our laws are to combat such egregious acts of lawlessness, however these same officials ignore the call to pass the laws they say would convict such acts. We'd like to know what the hold up is.

In very few instances have I ever seen such a great disconnect between lawmakers and the public it claims it serves. In very few instances have I seen such a clear, concise message being sent to lawmakers to act. It isn't every day that an entire nation becomes outraged at the lack of law, yet lawmakers fail to heed the call.

In many Internet stalking/harassment cases, perpetrators refuse to take responsibility for their actions. In both cases here, we have a complete lack of real concern from officials towards victims of these cases. They simply continue to point out the lack of legal recourse as if it were a bragging right.

Why wouldn't voters be outraged at lawmakers who waste massive amounts of time running American troop activities into the ground, while our own children are exploited, harassed, stalked and even murdered - all the while excusing themselves from responsibility by casting it off as a freedom of speech.

Laws that are eventually enacted are so weak, they often times rival the seriousness of a speeding ticket. It's really time the issue be fully explored as a priority at both the state and federal levels. Unfortunately we aren't optimistic that this will be the case - as lawmakers have already played the "freedom of speech" card in both cases here.

The story of this family is just awful. What kind of evil people would torment people they don't know with pictures of their dead daughter? We've become a nation without a conscience, sad to say.

And yes, there are laws already on the books that prosecutors could use to go after these scoundrels.

I actually heard a public service announcement on the radio today against "cyber bullying." It was sponsored by the Justice Department. The target of the cyber bullying was named "Megan" which I thought was tasteless.

On our site we deal with adults who abuse other adults via the internet. The legal system does ZERO for these vulnerable and now traumatized people. They say "you were an adult, you should have known better." A sociopath can fool anyone. Any time. And behind a keyboard, they feel invincible and totally anonymous about carrying out their sickness at the expense of others.

Here's just three of our stories of how this can happen to anyone:

We have a number of victims on our site - looking for help or justice with their online predator or sociopath.

1. Victim JT. One of the many wives of Nathan Thomas - Thomas is a serial bigamist and sex addict who meets his victims online (inocuous sites like penpalworld. Once he's convinced them he's ok he regales them with FALSE stories of being with the CIA and covert missions in Iraq. All lies. JT finally found out what he was via our site (another victim outed him a couple years ago) and the detectives in Vancouver are now telling her SHE has to do all the legwork to charge him with bigamy and fraud and sue him for annulment of their marriage.

JT is a single mom now, struggling to make ends meet and can't find a lawyer to take her case or anyone to help her because she's too broke. Thomas knew this and has even called to threaten her not to take action. She's pressing forward but its almost impossible. Media attention could bring her nightmare to an end. She is getting counseling for PTSD.

2. TM. This single, disabled mom was preyed on by a man she knew from college - 30 years ago. He is married, well known in his community, was the former publisher of Nickelodeon Magazine and former marketing director of Marvel during Spiderman 1. He had a seemingly spotless reputation. Once he restarted their relationship, knowing she was severely depressed and being badly abused by her ex-husband - he seduced her into an online affair, knowing she wouldn't question his agenda. He sent a homemade porn video to one of her friends - who sent it to the FBI - FBI did NOTHING (we have a copy) He also got her to give up the names of her female friends, under the guise of "we are friends" & he wanted to get to know her other friends. This predator tried to start actual physical affairs with at least 2 of them. Once TM found out about him from other women he threaten her children. TM went to NYPD. After some investigation, it was found this man was not only up to his neck in online porn & phone sex activities but , he was a long-time client of former NYC Midtown Madame, Julie Moya. Information turned over on him was used partly to arrest Moya and shut down her Julie NYC brothel. (do a search on "Julie Moya" - you will find it.)

The man was NEVER CHARGED by police with the many counts of soliciting they KNEW aboutand is walking around free as a bird - still working for a family publisher in Midtown. He has blamed her for every negative thing that's happened to him since (probably all done by other victims of his!) and has run an online & offline smear campaign on this disabled, single mom - knowing she has no money to fight him. She was hospitalized for the trauma after it all and is still in counseling. By the way, he is also a political blogger using a false name and new online nickname as well.

3. RM - had an affair with a man she knew from her church during a separation from her husband. Had no reason not to trust him. Found out later he was an online predator. Caught a serious STD from him and is still being treated for medical issues, on her own dime. After confronting him and coming clean to her husband she then exposed him. - the man sued her for "ruining his reputation" and blamed her for his "band" disbanding. She had no money to fight him and his unscrupulous lawyer.

This man also had her husband thrown in jail and despite settling with her - is continuing to harass her via the legal system. We have heard from 3 other women this man has preyed on this way - including a possible illegitimate child. Now that he's sued "RM" - all his other victims are scared to come forward.

This is one of the reasons we run our site. To help people like Megan's family and these women find some degree of justice. To know they were emotionally raped, blamed by the media and public, manipulated by a predator and traumatized is hard. All of them deal with varying degrees of PTSD.

The legal system failures are too familiar. And are allowing the Lori Drews of this world to run free while the victims pay & pay.

I think that more use of forensics would be of great value - it's more multidisciplinary in its approach. but who is being trained to be a forsenics expert on the internet as a apeciality?

The Meagan Meier case clearly points it out.

In India they have a magazine that is political, medical, social, just everything and people actually read it. But nothing like that exists in the USA or Canada (where I am) and the effects of the lack of the same can clearly be seen. Criminal justice is just so BAD. This summary justice by the cops has taken over as the RULE OF LAW has been broken down over several decades; it's not just BuZh who made it this way - he did make it far, far worse though.

While billions get spend on "protecting America" from so-called terrorists, nothing has been evident that shows that any American's safety is of much concern unless you can afford your own Blackwater guard!! your own taZer!! Personal safety has become a commodity.

I don't expect things to get better in the US of A anytime soon. And the people who will really suffer is the kidz.

A visit to a trade fair on products for cop shops should show everyone where "law enforcement" is heading.

There is a total lack of will on the part of politicians to turn the tide ..

We live in a society that so much of this gets defended as "free speech." I think it's a product of a dumbed down "gummint run skool" system, the products of which have no clue what the Founding Fathers concept of free speech was. It was free political speech.

What's been lost is the idea of "I can do it, but should I? Is it right?" That's also a result of 30-40 years of the schools teaching moral relativism, the concept of there not being any such thing as right and wrong. Everything is a gray area. I survived moral relativism because my parents taught me right from wrong, but how many kids are missing that?

As for the Justice Department PSA, that was no doubt a coincidence. It may have been recorded long before the Megan Meier incident. "Megan" is a fairly common name.

And in Illinois -- no recall provision --- so the politicians have free reign. Yes, you can vote them out, voters are soooooo apathetic and have short memories --- big bucks to run --- so you get the same old same old ---- most every election cycle. Our constitution is hanging on by threads......

Hiya, Danny.

The problem as I see is one of free speech. That's what happened with the accident scene photos involving Nikki. Republishing those photos is definitely a First Amendment issue, and I doubt anyone would force them to be removed.

However, when people are sending those gruesome photos to the family, when they don't even know the family, it's no longer an issue of free speech. It's harassment and stalking. Unfortunately, the internet is growing faster than legislation can keep up with it. Luckily, most of those types of actions can be prosecuted under existing law, if the prosecutor is willing to get creative.

Unfortunately, most prosecutors are not willing to do that, for fear that they will lose on appeal and thus tarnish their reputation.

In the meantime, the Catsouras family is doing the right thing, in filing a civil suit against the CHP. After all, had the CHP not released the photos in the first place, this would not be an issue at all. No matter how I view it, the CHP is responsible for all of the problems which followed, so I hope the family prevails.

This is and the release of those photos, beyond reprehensible. I looked for and found the photos. If I'd seen that of one of my sons, it may have literally killed me. I can't imagine anyone, being so hateful, so utterly evil, to have sent them to her family. It is just as bad that they have been published.
I do believe we need accountability here. Yes, we must police ourselves and call for an end to this behavior, in the media, as well.
I can only hope that they will find out just who it was that leaked the photos, who mailed them or whatever, to her family. Then, I do certainly hope, that my good friend, "Mz. Karma Bitchslap," does what she does best.

The sad part is this is just a few stories of this happening. Right now there is a BIG argument happening. Michael Crook (Scumbag) is taunting the citizens of Ocala, Florida over the deaths of 7 of their communities kids. All in the name of free speech. There are limits to free speech. I mean you wouldn't go to the airport and talk about building a bomb in your shoe because you'd be picked up and questioned while missing your flight.

There is a new senate bill that is being considered and it plainly established cyber harrassment as a crime and also makes a case for stalking.

I just wanted everyone to know that one of the attorneys involved in this case, R. Rex Parris is running for Mayor of Lancaster California. This man has ridiculed the family, called them "silly" and "emotional" in the press, and has ardently defended the right of people to post these disgusting photo's all over the internet.

People is probably just resentful because this "daddy girl" was intoxicated, took his dad's porsche without permission and drove at over 100 miles/hour and before slamming into a concrete tollbooth she slammed into an innocent driver that was sent to the hospital with serious injuries. If she had survived the accident or better yet, if she hadn't crashed in the toollbooth and the other victim would have died she would have landed in jail for manslaughter, DUI and everything in the book. She would not longer be portrayed as the beautiful, innocent 18 year old we are seeing in that picture.
I feel sorry for her parents but not for the spoiled Nikki.

I just googled the pictures of her and well I wish now that I hadn't. Her family should not have to remember her in such a heinous fashion. I pray for their healing, and I pray that the person she injured to have a full and speedy recovery.

I feel terrible for what Nikki's family has to go through. I pray for them. and for the people who think she was intoxicated, she wasn't. Her parent's told the police that so that they would track down Nikki faster so that they could bring her home. She wasn't a bad kid. She was beautiful, and made a very fatal mistake.
