No Law Fits the Megan Meier Case? Really?

Take a close look at the Missouri Statute

Endangering the welfare of a child in the first degree, penalties.

568.045. 1. A person commits the crime of endangering the welfare of a child in the first degree if:

(1) The person knowingly acts in a manner that creates a substantial risk to the life, body, or health of a child less than seventeen years old; or

(2) The person knowingly engages in sexual conduct with a person under the age of seventeen years over whom the person is a parent, guardian, or otherwise charged with the care and custody;

(3) The person knowingly encourages, aids or causes a child less than seventeen years of age to engage in any conduct which violates the provisions of chapter 195, RSMo;

(4) Such person enlists the aid, either through payment or coercion, of a person less than seventeen years of age to unlawfully manufacture, compound, produce, prepare, sell, transport, test or analyze amphetamine or methamphetamine or any of their analogues, or to obtain any material used to manufacture, compound, produce, prepare, test or analyze amphetamine or methamphetamine or any of their analogues; or

(5) Such person, in the presence of a person less than seventeen years of age or in a residence where a person less than seventeen years of age resides, unlawfully manufactures, or attempts to manufacture compounds, produces, prepares, sells, transports, tests or analyzes amphetamine or methamphetamine or any of their analogues.

2. Endangering the welfare of a child in the first degree is a class C felony unless the offense is committed as part of a ritual or ceremony, or except on a second or subsequent offense, in which case the crime is a class B felony.

and that is just the Missouri 2nd degree murder statute... What about harassment? Child exploitation? Manslaughter?

This was on the O'Reilly show last night. They had two attorneys on who said there is a law that just recently went into effect that can be used to charge the Lori Drew. They also said the Meiers should sue the Drews in Civil Court, that they would win, and the settlement would be huge.

yes, attorneys all over the country are challenging the assumption that no law applies. It would seem as though lori's friendship with the city council isn't hurting her, that's for sure.

Joyell, case law is all about applying the laws on the books to the specifics of a crime. Laws do not generally describe a crime down to it's nuts and bolts. If it did, a Judge wouldn't be required to decide a case. a Jury wouldn't have to debate whether a law had been broken... Few cases are slam dunk cases where the proof rock solidly matches the exact text of legislation. The County Prosecutor's office says this is the first they have even seen the case. Major dropping of the ball here!

Fighter2 that's quite true. I'm willing to bet a good prosecutor could at least bring a motion under many different chapters of criminal law.

The State of Missouri knows it doesn't have to win every case. So why would St. Charles put the city in turmoil when a Judge can decide the case?

This whole thing makes no sense. A full year and nothing was done about the Drews? but law enforcement allowed the Drews to file for property damage against the Meiers?

Talk about screwed up priorities.

Makes us wonder if the Drews don't have friends in high places.

Internet harassment using a false identity was and is already a federal felony under 47 USC 223, before this happened.

Excerpt: "Whoever...utilizes any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet... without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person... who receives the communications... shall be fined under title 18 or imprisoned not more than two years, or both."

Really? So you feel there is no law to prevent an adult from engaging a child in a sexual conversation, luring him/her into a relationship, maintaining that relationship for 6 weeks under completely false pretenses and then exploiting that child's clinical depression for the adults own gain?

All of that is free and clear of every law on the books? None of those activities could even go before a Judge to decide?

I'd say it will be mighty hard to get Missouri tax payers to agree with all that, but we respect your opinion.

In this case, lori Drew should have IMMIDIATELY been arrested and charged with voluntary manslaughter. this shows that this states Law Enforcement agency is corrupt, and the state should take into serious consideration the firing and replacement of every law enforcement officer involved in this case
