Megan Meier - New Law Fatally Misses The Mark


Dardenne Prairie, Mo (The Weekly Vice) - On Wednesday, October 21st, city officials wasted no time enacting an ordinance designed to address the public outcry for justice in the Megan Meier tragedy. The six member Board of Aldermen made Internet harassment a misdemeanor, punishable by up to a $500 fine and 90 days in jail.

But as details of the new law come to light, serious flaws are beginning to surface which suggest the new law may be ineffectual, may conflict with Freedom of Speech rights and may not even apply to the case it was designed to address. The Vice would agree with the first and third concern.

While most critics of the case remain unimpressed with the new measure, city officials have succeeded in appeasing some. Officials who are eager to quiet critics point to this "feel good" ordinance, although they acknowlege it's limitations.

Does this new law provide any justice for Megan? Does this law provide equitable relief for a future victim?

There's a hole in the bucket

The Vice rejects the premise of this new law and believes it completely misses the mark. The reasoning behind this opinion is that city officials have consistently treated this case as an Internet harassment case instead of a child welfare/exploitation case.

Classifying this case as a harassment issue completely fails to address the most serious aspects of the methods Lori Drew employed to lead this youth to her demise. The Vice disagrees that harassment was even a factor in this case until just a couple of days before Megan's death.

Considering this case a harassment issue is incorrect because during the 5 weeks Lori Drew baited and groomed her victim, the attention was NOT unwanted attention. Megan participated in the conversations willingly because she was misled, lured, manipulated and exploited without her knowledge.

Ordinance Sets a Disturbing and Backwards Precedent

This law willfully sets a precedent that future child exploiters and predators might use to reclassify their cases as harassment cases. In effect, the law enacted to give Megan justice, may make her even more vulnerable. So long as the child victim doesn't tell the predator to stop, even a harassment charge may not stick with the right circumstances and a good defender.

Our 13 year old children should not be expected to stop their own seduction. What happens when future child predators defend themselves by insisting their activity was invited? This leaves an incredible opening in the legal code for officials to discard cases they feel aren't worthy of the stiffer penalties for Child Predators that are now on the books. Even if a prosecutor was successful in establishing the harassment, a Judge is free to deliver the same kind of penalty a speeding ticket would impose. Maybe less.

Every aspect of this case follows the same procedural requirement used to convict a Child Predator. A child was manipulated by an adult. A child was engaged in sexually explicit conversation (as acknowledged by Lori Drew herself). An adult imposed her will on a child by misleading her, using a profile designed to sexually or intimately attract the 13 year old Megan.

Lori then utilized the power she had gained over this child to cause significant distress and endangerment to that child. She even stipulated to many of these activities in the police report she filed shortly after Megan's death.

We can go on and on here, but the parallels between this case and many other child predator cases that are successfully prosecuted bear striking similarities.

Child Predator laws do not require much more than simply proving that an adult has engaged a minor in sexually explicit conversation. Lori Drew has already stipulated that her conversations with Megan were sometimes sexual for a child Megan's age.

City officials who continue to ignore this viable, documented admission and continue to address this issue as harassment are intentionally burying their heads in the sand, when the solution is staring them right in the face. Why?

New Law Weakens Older Laws

On June 5th, 2006, Governor Matt Blunt signed into law stiff penalties for convicted sex offenders. The Vice believes that officials continually reject a child predator classification of this case in order to keep the penalty of this offense out of this harsher realm.

Opponents of this law are active in defeating this law not by changing it, but by disqualifying cases like Megan's from ever being heard.

There are several other child exploitation laws on the books. To date, none of them have even been considered by City, State and Federal officials in this case. The Vice is outraged that a motion was never even filed, so that the case could at least be argued before a judge or jury.

Lastly, the ordinance enacted Wednesday has one more tell tale sign of it's real limitations. It applies only to residents of Dardenne Prairie. If a predator/harasser stalks a child from a computer that's one foot outside of the city line, this ordinance would get the same response from city officials that Megan Meier's case has achieved thus far.

We agree Vice! Completely inappropriate and without any real teeth. A lame effort to make good for poor Megan & her parents... over a year late and millions of tears short.

Victims of Online Predators, child and adult, need more. More justice and more respect.

BTW - what happened to INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS??
Lori Drew continues her remorseless dance away from any culpability.

I don't have a copy yet, but the outline of it has been reported by the AP. We also know that it's quite limited in scope since it's a local ordinance that caps penalties at $500 fines and 90 days.

We also know it's "harassment" based, which in my opinion does nothing but provide a plea bargain possibility for out and out child predator cases... not just a- typical cases like this.

So there's no doubt this ordinance has hole all over it. Even the legislators on hand worried that this law would be challengable.

Danny - 2 of us co-wrote this article in 2005. In retrospect, it describes the pathological behavior of Lori Drew to a tee.

It's the whole reason we started our site - to out these emotional rapists & cyberpaths. Not for revenge, but because the victims were told to "move on" or "get over it" by the victim-blaming public. (again, sounds like Lori Drew, et al.)

Once we started our site 3 years ago we have consistently heard that we are sick, pathetic people trying to ruin lives & families - always from the Cyberpaths & their proxies. Only remorseless, sick, self-involved people see their own pain but can't fathom anyone elses. Again - Lori Drew fits.

That the law in that town only called it a misdemeanor with a $500 fine is pathetic. Someone is covering for someone here. Are the Drews politically connected? Is there a predator involved with town politics?

Something smells here, as it often does when we do our investigating. Only the guilty scream loudly.

First, let me say I have the utmost sympathy for the Meiers and I hope they are getting the help (financial, legal, and psychological) that I'm sure I would need in their circumstances. I also wish they would move because I doubt there can be peace for them ever in that neighborhood. I am so impressed by them and their dignity. God bless them, and help them find peace.

With regard to the case itself, I find people are assuming all sorts of things about Lori Drew's intentions here. They accept on face value her story that she was trying to find out what Megan was saying about her daughter. I don't know her motivations, but I don't think we should accept her own (cover) story. Her final message (viz. 'the world would be a better-off place without you') was a pretty explicit call for suicide. I'm not saying she intended the outcome consciously, but her actions did contribute, and we don't really know her motivations.

I had posted the comment about the Sylvia Likens case the other day. I'm not saying Drew is a murderess, yet her actions clearly contributed to a death. In the case of Baniszewski, she kind of "kept her own hands clean" and had others do her dirty work for her. A particular kind of sociopath likes to work that way. No one ever could imagine skinny, frail and diminutive Mrs. Baniszewski would have been able to murder Sylvia on her own. It took a lot of help from some strong young people whom she ordered around. Drew also seemed to enjoy playing puppet master to a bunch of young people who already had it in for Megan (her daughter; the hired girl who already hated Megan in June for interfering with her own relationship, as recorded on her daily blog). It takes a very sick mind to take these childish enmities and twist them and groom them into reality-based harm to another young child. It's like she's the reverse Peter Pan or something.

Like I say, I'm not accusing Drew of desiring this outcome, but I'm not absolving her from it either. It's a very strange case and all possibilities should be considered.

I think the Meiers should sue her socks off. Also, her claim that she is less guilty because Megan may have already talked about suicide is specious. In tort law there's a principle, unfortunately I can't remember what it's called, but it says that the responsibility of a defendant does not diminish because of any pre-existing condition in the victim. An example might be, if I had back problems and slipped on someone's icy driveway, it wouldn't matter that I already had back problems, I could sue them for putting my back out because of their driveway conditions.

Once again, may the Meiers find justice and/or retribution through the civil courts, and may they also find peace (eventually, I know it may take a while).

Imagine this...

Sometime in the future a male adult preys on a male teen. He baits and lures the child. Talks about sexually charged topics and inevitably forms a relationship with the child.

Many child predators are caught at this point before they ever get the chance to make the online affair personal.

Officials prosecute the case not on the intent to actually carry out the act, but just simply forming a relationship of this kind with a child.

Lori drew by her own admissions followed this same path. Had she been a male going after a male, it's highly possible the case would have been prosecuted with or without a suicide in the end.

Just the explicit conversation, imposed relationship and exposure to that level of adult conversation is already enough by itself to qualify for some kind of charge.

Really.... never mind the suicide... Lori's actions all by themselves cross the line, and did so for many many weeks.

Second, this new "law" is a travesty. Just saying this law is not enough is inadequate.

A new law (which the Court may or may rule Constitutional) is a weak CYOA reaction. Lori Drew and her accomplices could be charged with any number of existing laws, including sexually baiting a minor.

A number of other states maintain web pages that list the names and addresses, as well as mug shots, of any person convicted of a sex crime, including the mere possession of sexually explicit photos of minors or even subjects who appear to be minors.

The Missouri statutes contain a number of crimes that the state could charge Lori Drew with, but instead the city council just votes in a hastily drafted new law that Lori Drew cannot be charged under. That smells like grandstanding.

I would also like to point out a major fact that has not yet been mentioned in this case.

The music industry has successfully prosecuted Peer2Peer file sharers.

They do so without proving that any particular person was in front of their computer at the time the "crime" occured.

These cases are successfully prosecuted against the owner of the isp.

Why should a child's rights be protected any less than a music distributor's rights?

The difference is that the music industry has hundreds of thousands of dollars to invest in pursuing it's case. The Meier family however does not have these resources.
